Terms of Use for Fetra Community Platforms

The terms governing use of Fetra Community's platforms, the intellectual property rights in its content, and the limits of liability in its programmes and Consultation Centre.

Definitions and Parties

"the Community" or "we": Fetra Community, a volunteer-led educational community not registered as a legal person, operating from Istanbul, including its platforms: the main site, Fetra Academy, the Fetra app, the Fetra AI Assistant, and the Consultation and Support Centre. "the User" or "you": anyone who visits the platforms, registers on them, or uses their services. "Content": everything the platforms present: texts, articles, study tracks, lectures, recordings, publications, illustrations, designs, marks, logos, and programme names.

Acceptance of These Terms

By using any of our platforms you confirm that you have read these terms and agree to them. Anyone who does not agree should not use the platforms. This document is to be read together with our Privacy Policy as a single whole.

Accounts and Membership

Membership is free, and users create an account with accurate details of their own. You are responsible for keeping your password confidential and for all activity carried out through your account, and you must inform us as soon as you become aware of any unauthorised use. Accounts may not be shared, sold, or transferred.

We may suspend or close an account where its holder breaches these terms or harms the platform or its members, and we will inform them unless doing so would prejudice an investigation.

Acceptable Use

Users may not: impersonate another person; publish anything contrary to Islamic law or to applicable law, or anything abusive, inciting, or contemptuous; harass members or practitioners; harvest members' data or contact them for promotional purposes; attempt to breach, disrupt, or probe the platforms without written permission; use automated tools for the systematic extraction of content (crawling or scraping) beyond what robots.txt permits; or use the platforms for commercial activity unrelated to the Community.

Support Groups and Member Contributions

What is said in the Circles of Safety and the Fitrah Circles is a trust upon every participant, not upon the facilitator alone. Everyone who joins undertakes a covenant of confidentiality: not to relay anything said by another outside the group, not to record the meeting in audio or video, and not to photograph it. Anyone who breaches this is removed from the group, and personal responsibility for what they disclosed remains theirs alone.

The Community does its utmost to safeguard these spaces, but it does not guarantee the conduct of individuals within them and bears no liability for what a participant discloses in breach of that covenant.

Likewise, files a user uploads or text they enter in our forms remain their responsibility as to accuracy, lawfulness, and their ownership of the rights in what they upload. By uploading it they grant us a limited licence to use it solely for the purpose of providing the service.

The Nature and Limits of Our Content

The Community's content is educational, formative, and awareness-raising, offered for general benefit. It represents scholarly judgement disciplined by the foundations of Islamic law, not a binding religious ruling for a particular person in a particular case. Anyone facing a matter specific to their own circumstances should consult qualified scholars in their own country.

Presenting or relaying a view within our content does not amount to adopting it in every respect, and nothing said by a guest on our podcast or at a gathering is attributed to the Community unless expressly stated.

We take care over the accuracy of what we publish, but do not warrant it free of error or oversight. Anyone who finds a mistake should write to us: for us, correction is a virtue, not a defect.

Programmes, Consultations, and the Limits of Responsibility

What we provide: accompaniment, consultation, and psychological, educational, and family support, according to a methodology joining the methods of contemporary psychology to the stillness of faith.

What we do not provide: medical diagnosis, clinical psychological or psychiatric treatment, prescription of medication, or an emergency service. The Centre's team includes psychological specialists and physicians, and the physicians' role is precisely defined: to identify what falls within the scope of medical care, to determine which cases require medical treatment, and to advise on referral, without providing psychological or psychiatric treatment within the Centre, which is reserved to accredited medical bodies alone.

Emergency notice: the Centre does not operate around the clock. If you or someone you know is in immediate danger, contact your local emergency services at once.

No professional or therapeutic relationship arises between us: using the platforms, attending a programme, or submitting a consultation request creates no doctor-patient, therapist-client, lawyer-client, or mufti-questioner relationship. What takes place in a session is accompaniment and guidance within the scope declared in this clause.

The practitioner and beneficiary relationship: our practitioners work according to the Community's methodology and rules, and each is professionally responsible for their own practice and for the accuracy and currency of the qualifications and licences they present. The Community bears no liability for an opinion or action by which a practitioner departs from their declared scope or from the Centre's rules, nor for any contact or arrangement made between a practitioner and a beneficiary outside the platforms.

The status of those who act for the Community: work at Fetra Community is voluntary, and creates no relationship of employment, agency, or partnership between the Community and those who volunteer with it. Any claim arising from the services is directed to the Community in its own capacity, and not to the individuals who lead it, its volunteers, its practitioners, or the members of its scholarly board in their personal capacities, so long as they are acting within that capacity and within the Community's rules.

Your decision is your responsibility: what is offered to you is opinion and counsel to help you consider a matter. The decision concerning yourself, your family, your health, and your property is yours alone, and you bear its consequences. Anyone whose situation calls for the opinion of a medical, legal, or religious specialist in their own country should seek it; what we offer does not stand in its place.

Outcomes: our programmes are offered in good faith and with diligence, but we do not guarantee any particular outcome in the case of an individual or a family; educational and psychological effect depends on many factors beyond our hands. Decisions about your own affairs remain yours, and the responsibility for them is yours.

Admission: not every applicant is admitted; the Community may decline a request or direct it to a more suitable path.

Children and Minors

No one under 18 may be admitted to our programmes, and no consultation request may be submitted for them, except with the knowledge, consent, and details of a legal guardian.

Intellectual Property

Everything presented on Fetra Community's platforms is reserved to it or to those who have licensed it to it: texts, articles, programme descriptions, course content, lectures, audio and video recordings, publications, diagrams, designs, and the arrangement and editorial structure of its pages.

The following names and marks are distinctive marks of the Community, and neither they nor anything confusingly similar to them may be used: "مجتمع فطرة" and "Fetra Community", its logo and symbol, the strapline "Planting Faith · Building Knowledge · Practical Impact"; the names of its programmes and services: Amsiyāt, Youth Accompaniment, Pre-Marital Preparation, Circles of Safety, Fitrah Circles, Fetra Academy, Fetra AI Assistant, Fetra App, the Consultation and Support Centre, and the Fitrah Endowment; and the titles of its publications: The Fitrah Triad, Fitrah Circles, and The Covenant of Spouses.

The intellectual property rights of The Fitrah Triad and all reference publications remain reserved to their respective authors and are published under licence to the Community.

What Is Permitted and What Is Not

You may, and we welcome it: read and benefit; share links to our pages as they are; quote a limited passage for reporting, criticism, or teaching, on two conditions and no others: express attribution to "Fetra Community" or to the author of the text, and a link to the original page; and download the publications available to you for your personal use.

You may not: republish an entire work or a substantial part of it on a site, channel, newsletter, or in a book; translate it into another language and publish it; paraphrase it and attribute it elsewhere; modify it or create derivative works from it; use it in a commercial product or service; remove copyright notices or marks from it; re-upload our publications to other platforms or circulate them outside their approved route; or use our content to train artificial-intelligence models, or in systematic automated text and data extraction, without our prior written permission.

Anyone wishing to go beyond this, whether translation, joint publication, or institutional or educational use within their organisation, will find our door open to a written permission, requested through the "Contribute" page or by writing to us. We make this straightforward rather than difficult: our aim is that good should spread while attributed to those it belongs to, not that it be hoarded.

Payments, Pricing, and Refunds

Electronic Payments: online payments for platform memberships, services, and printed titles are handled through an authorized payment gateway adhering to international security standards (PCI-DSS). All prices and charges are clearly displayed prior to order confirmation.

Print Copies & Fulfillment: physical publications are fulfilled and dispatched to supported addresses via authorized shipping couriers, providing recipients with tracking details.

Refunds & Cancellation: refunds or cancellations are processed in accordance with service-specific terms prior to service consumption or shipment dispatch.

Third-Party Services and Interruptions

Some of our services rely on external providers: hosting, email, a video-call provider, a carrier, and publishing platforms. We choose them with care, and bear no liability for a failure, interruption, or defect occurring on their side.

The platforms are provided "as is" and "as available". We work to keep the service continuous and secure, but do not warrant that it will operate without interruption or error, and we may modify a service, suspend it, or change its terms, giving prior notice of material changes.

Limitation of Liability and Indemnity

To the extent permitted by applicable law, neither the Community nor those who run it, its volunteers, or its practitioners shall be liable for any indirect, consequential, or incidental loss arising from use of the platforms, reliance on their content, or inability to access them.

Nothing in this document excludes liability that the law does not permit to be excluded, such as liability for fraud, gross negligence, or matters affecting personal safety.

Cap on liability: the Community's services are offered voluntarily and without charge, and its liability shall in no circumstances exceed what the user actually paid for the service in question, which is in most cases nothing.

Users shall indemnify the Community, those who run it, its volunteers, and its practitioners against any loss, claim, or cost arising from their breach of these terms, from content they have uploaded or shared, from their disclosure of what passed within a support group, or from use of the platforms otherwise than as permitted.

Time limit for claims: any claim arising from these terms or from the services must be brought within twelve months of the claimant becoming aware of the event giving rise to it, failing which the right to bring it lapses, to the extent permitted by the applicable law.

Governing Law and Dispute Resolution

These terms and any dispute arising from them shall be governed by and construed in accordance with Turkish law, and the courts and enforcement directorates of Istanbul shall have exclusive jurisdiction.

Reporting an Infringement

If you believe content on our platforms affects a right of yours, or you find our content published elsewhere without permission, write to us at info@fetracommunity.org with a statement including: a description of the material, its address in both places, evidence of your standing, and your contact details. We examine such reports and take what is necessary within a reasonable period.

Changes and Contact

We may amend these terms as our services develop; the date of the last update and the version number are recorded at the head of this page. Where an amendment is material we will inform you before it takes effect, and your continued use of the platforms thereafter constitutes acceptance.

General Provisions

Suspension and termination of accounts: the Community may suspend or terminate an account, or exclude a participant from a programme or a support group, where they breach these terms or cause harm to others or to the safe environment on which the service rests. Notice will be given, unless protecting others requires acting at once.

Severability: if a competent authority holds any provision of these terms to be void or unenforceable, the remaining provisions continue in force, and the void provision is replaced by the nearest enforceable provision to its purpose.

No waiver by forbearance: the Community's forbearance in enforcing a right on one or more occasions is not a waiver of that right or of any other.

Entire agreement: this document, together with the Privacy Policy, constitutes the whole of what is agreed between the parties concerning use of the platforms, and supersedes any prior understanding or promise on the subject.

Assignment: the user may not assign their rights or obligations under these terms. The Community may assign them to an entity succeeding it in the same activity, on prior notice.

Force majeure: the Community is not answerable for delay in, or failure of, any obligation caused by something beyond its reasonable control, such as network failure, disaster, conflict, decisions of authority, or faults at its service providers.

Languages: this document is published in Arabic and English. The Arabic version governs in the event of any difference in interpretation; the English is a translation offered to aid understanding.
